Marketplace Buyer Terms

These terms apply when you buy products, gift cards, services, or event tickets ("Items") from businesses ("Sellers") through allthethings.gay. allthethings.gay is run by Embarc Creative Co. LLC, an Arkansas limited liability company doing business as allthethings.gay ("we," "us"). Our Terms of Use and Privacy Policy also apply.

1. You're Buying From the Seller, Not From Us

• The Seller is the merchant. When you check out, your contract is with the Seller named on the storefront and the receipt. Your card statement will show the Seller's name, and your payment goes directly to the Seller's own Stripe account.
• We don't sell, ship, or hold Items or money. We run the website where Sellers list Items. We don't make, inspect, store, or guarantee them.
• There's no extra fee from us. We never charge buyers. The price you see is set by the Seller.

2. Before You Buy

Each storefront shows the Seller's prices, shipping costs and times, return and refund policy, and contact information. Please read them. For event tickets, the price shown includes all mandatory fees. Taxes and shipping are shown before you pay.

You must be at least 18 to buy, or have a parent or guardian's permission and supervision. Some Items may have higher age requirements.

3. Payment

Payments are processed by Stripe on behalf of the Seller. Stripe handles your card details under the Stripe Privacy Policy; we never see your full card number. Your receipt comes from the Seller.

4. Shipping, Returns, and Refunds

The Seller is responsible for delivering your Item and for returns and refunds under its posted policy and the law. If there's a problem:

1. Contact the Seller first, using the contact information on the storefront or receipt. Most problems are fixed quickly.
2. If the Seller doesn't respond within 3 business days or you can't resolve it, tell us at support@allthethings.gay with your order number. We'll reach out to the Seller and may take action against Sellers who don't handle problems fairly. We can't issue refunds ourselves.
3. You also have your card issuer's protections, including the right to dispute a charge for Items not received or not as described.

5. Gift Cards and Tickets

Gift cards are issued by and redeemable only with the Seller, under the Seller's terms and applicable law. Event tickets are issued by the event organizer; if an event is canceled, contact the organizer for a refund.

6. Your Information

When you buy, the Seller receives your name, email, shipping address (if needed), and order details so it can complete your order. The Seller may use it for marketing only if you opt in. We keep a record of the order to run the marketplace and help with problems. See our Privacy Policy.

7. Reviews

You may review Items and Sellers under our Community Guidelines. Honest reviews, positive or negative, are welcome. Sellers can't pay or reward you for reviews.

8. Prohibited Items and Reporting

Sellers must follow our list of prohibited items in the Marketplace Seller Terms. If you see something that shouldn't be sold, or a Seller you think is a scam, report it at support@allthethings.gay.

9. Limits on Our Responsibility

Because we're not the Seller, we aren't responsible for Items, their quality, safety, legality, or delivery, or for what Sellers say about them. The disclaimers, liability limits, and dispute resolution terms in our Terms of Use apply. Nothing in these terms limits rights you have against the Seller or your card issuer, or rights under consumer protection laws that can't be waived.
