Terms of Use
Effective date: October 14, 2026 Last updated: October 14, 2026
These Terms of Use ("Terms") are an agreement between you and Embarc Creative Co. LLC, an Arkansas limited liability company doing business as allthethings.gay ("allthethings.gay," "we," "us," or "our"). They cover your use of allthethings.gay, its subdomains, our newsletter, our apps, and anything else we run that links to these Terms (together, the "Service").
Please read them. By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
Section 17 includes a binding arbitration agreement and a class action waiver that affect how disputes are resolved. You can opt out within 30 days.
1. Who We Are and What We Do
allthethings.gay is a free directory that helps people find LGBTQIA+-owned and LGBTQIA+-friendly businesses, health care, community groups, events, and resources. People never pay to use it. We earn money from optional business plans, sponsorships, and advertising, and those never decide whether a business is listed or what badges it has.
Other terms apply to specific parts of the Service:
- Businesses that claim a listing or buy a plan: Business Terms
- Sponsors and advertisers: Advertising and Sponsorship Terms and Ad Content Policy
- Sellers in our marketplace: Marketplace Seller Terms
- People buying from marketplace sellers: Marketplace Buyer Terms
- Everyone who posts anything: Community Guidelines
- Copyright complaints: Copyright and DMCA Policy
If those terms conflict with these Terms, the more specific terms win for that topic.
2. Who Can Use the Service
Anyone may browse the Service. To submit anything to us (a suggestion, review, form, newsletter signup, account, claim, or purchase), you must be at least 18 years old.
If you use the Service for a business or organization, you confirm that you're allowed to act for it, and "you" includes that business.
You may not use the Service if we've previously removed you from it, or if you're barred from receiving services under U.S. law.
3. Your Account
Some features may require an account. Keep your login details private and tell us right away at hello@allthethings.gay if you think someone else has access. You're responsible for what happens under your account unless it happened because of our failure. Give us accurate information and keep it current.
You can close your account any time by emailing privacy@allthethings.gay or using account settings when available.
4. Listings and Information Are Not Guarantees
Listings are built from public information, suggestions from the community, and what businesses tell us. Badges show what we checked and when; they are explained on our Badges page. We work to keep things accurate, but:
- Businesses change. Hours, staff, prices, ownership, and policies may be out of date.
- Words like "welcoming" or "inclusive" describe how a business says it treats people or how community members describe their experience. It is not a promise of any particular experience.
- We don't employ, endorse, or supervise the businesses, providers, or organizers listed, and we're not a party to anything you arrange with them.
Please use your own judgment, especially about your safety. If something is wrong, tell us through the "Something wrong?" link on any listing or hello@allthethings.gay.
5. Health, Legal, and Financial Information Is Not Advice
Listings and guides about health care, therapy, legal help, name and gender marker changes, money, and similar topics are general information. They are not medical, mental health, legal, tax, or financial advice, and using the Service does not create a doctor-patient, therapist-client, or attorney-client relationship with us or with anyone listed.
Where we say a license was checked, that means we looked it up with the issuing board on the date shown. It does not mean we've evaluated the provider's skill or quality of care. Always check with a qualified professional about your own situation.
6. Crisis Resources
If you are in danger or thinking about harming yourself, call or text 988 (the 988 Suicide and Crisis Lifeline) or call 911. LGBTQIA+ specific options, such as the Trevor Project and Trans Lifeline, are listed on our Support pages.
We list crisis and support services so you can find them. We don't operate them, can't monitor or respond to messages sent to us as a crisis service, and can't guarantee that any third party will be available at any given time.
7. Things You Post
"Your Content" means anything you send or post: suggestions, corrections, reviews, photos, comments, form responses, and listing details.
You keep ownership of Your Content. You give us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, copy, display, adapt (for example, resize or translate), publish, and distribute Your Content in connection with running, improving, and promoting the Service, including on our social accounts and in our newsletter. This license lasts while Your Content is on the Service and for a reasonable time after removal for backups, legal compliance, and copies already shared. For reviews, it continues after you close your account unless you delete the review first, so that ratings stay accurate.
You promise that you have the rights to post Your Content, that it's truthful to the best of your knowledge, and that it follows our Community Guidelines.
We may review, edit for format, decline, remove, or restore Your Content at our discretion, but we have no duty to do so. We don't remove honest reviews because a business pays us or asks us to. See the Community Guidelines.
Feedback. If you send us ideas or suggestions about the Service, we may use them without owing you anything.
8. Rules for Using the Service
Don't:
- Break the law or help anyone else break it.
- Harass, threaten, out, dox, or target anyone, including for their sexual orientation, gender identity, or any other trait.
- Post false information, fake reviews, or reviews you were paid or rewarded to write (see the Community Guidelines).
- Pretend to be someone else or a business you don't represent.
- Scrape, crawl, copy, or bulk download listings, reviews, or other data, except search engine crawlers that follow our robots.txt, or as we allow in writing.
- Use the Service or its data to build a competing directory, train a commercial AI model, or compile information about people who use it.
- Use the Service to identify, track, or report people based on their sexual orientation, gender identity, health, or visits to any listing.
- Interfere with the Service's security or operation, or try to get around rate limits or access controls.
- Send spam or unsolicited marketing to businesses or people you find on the Service.
9. Our Content and Brand
The Service, including our design, text, compiled directory, badges, logos, and the name allthethings.gay, belongs to us or our licensors and is protected by copyright, trademark, and other laws. We give you a personal, non-exclusive, revocable license to use the Service for its intended purpose. You may share links and individual listings. You may not use our name, logo, or badges in a way that suggests we endorse you, except as allowed in our Business Terms or Brand Guidelines.
10. Ads, Sponsors, and Paid Placements
The Service shows sponsored content and paid placements. They are always labeled (for example, "Sponsored" or "Featured"). Paying us never buys a badge, a review, or a higher rating. Ads are matched to the page you're on, not to you; see our Privacy Policy. We're not responsible for advertisers' products or claims.
11. Third-Party Sites and Services
The Service links to websites, booking tools, apps, and services we don't control. Your use of them is governed by their terms and privacy policies, not ours.
12. Marketplace Purchases
When you buy something from a business on allthethings.gay, you are buying from that business, not from us. The business is the seller, handles payment through its own Stripe account, and is responsible for the product, shipping, returns, and refunds. See the Marketplace Buyer Terms.
13. Changes to the Service and These Terms
We may change, add, or remove features at any time. We may update these Terms. If a change is material, we'll give at least 30 days' notice by posting it on the Service and, if we have your email, by emailing you, before it takes effect. Changes don't apply to disputes that arose before they took effect. If you keep using the Service after a change takes effect, you accept it.
14. Suspension and Termination
You can stop using the Service at any time. We may suspend or end your access, or remove Your Content, if you break these Terms, if needed to protect people or the Service, or if required by law. Where reasonable, we'll tell you why and give you a chance to respond. Sections that by their nature should survive (for example, 7, 9, and 15 through 19) survive termination.
15. Disclaimers
The Service is free and provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that listings are accurate, complete, or current, or that the Service will be uninterrupted or error-free.
Some states don't allow these exclusions, so some may not apply to you.
16. Limits on Our Liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill.
- We are not liable for the acts, omissions, products, or services of any business, provider, organizer, seller, advertiser, or other user.
- Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100.
These limits don't apply to liability that can't be limited by law, such as for gross negligence, fraud, or willful misconduct where state law prohibits limiting it.
Indemnity. If you break these Terms or the law, or your content infringes someone's rights, and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim. This doesn't apply to claims caused by our own conduct.
17. Resolving Disputes
Talk to us first. Most problems can be fixed quickly. Before filing any claim, email hello@allthethings.gay or write to the address below with your name, contact information, and a description of the problem and what you want. We'll try to resolve it informally within 60 days.
Governing law. These Terms are governed by the laws of the State of Arkansas and applicable U.S. federal law, without regard to conflict of laws rules.
Arbitration. You and we agree to resolve disputes through final, binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with any hearing held in Pulaski County, Arkansas (or by video or phone if you prefer), except that either of us may (1) bring an individual claim in small claims court, and (2) seek an injunction for misuse of intellectual property. You and we waive the right to a jury trial and to take part in a class, collective, or representative action. If 25 or more similar claims are filed by the same or coordinated counsel, they will be administered in batches under the administrator's mass arbitration procedures. For claims under $10,000, we will pay the filing and arbitrator fees. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@allthethings.gay with your name and the statement that you opt out. If the class waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
18. General Terms
These Terms and the policies they link to are the whole agreement between you and us about the Service. If a part is unenforceable, the rest stays in effect. If we don't enforce something right away, we haven't waived it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets with notice to you. Neither of us is responsible for delays caused by events beyond reasonable control. There are no third-party beneficiaries. Headings are for convenience only. "Including" means "including without limitation."
California users. Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
