Business Terms
Effective date: October 14, 2026 Last updated: October 14, 2026
These Business Terms apply to any business, professional, nonprofit, group, or organizer ("Business," "you") that claims or manages a listing, buys a plan, opens a storefront, or otherwise uses the business features of allthethings.gay. They're an agreement between you and Embarc Creative Co. LLC, an Arkansas limited liability company doing business as allthethings.gay ("we," "us"). They add to our Terms of Use, which also apply. If you sell through our marketplace, the Marketplace Seller Terms also apply. If you buy sponsorships or ads, the Advertising and Sponsorship Terms also apply.
The person accepting these terms confirms they have authority to bind the Business.
1. Free Listings
Every eligible business can be listed for free, forever. A free listing includes your name, category, address or service area, contact details, hours, a description, photos limit, and the badges you earn. We may create a listing from public information or a community suggestion before you claim it; those listings are marked "Not Yet Verified."
Who belongs here. We list LGBTQIA+ owned businesses and businesses, providers, and organizations that treat LGBTQIA+ people with respect. We may decline, pause, or remove a listing that doesn't fit, including any business that offers or promotes conversion therapy, or that is reported and confirmed to have discriminated against LGBTQIA+ people. We'll tell you why and give you a chance to respond, except where a delay could put people at risk.
Removal requests. If you don't want to be listed, email hello@allthethings.gay from your business email and we'll remove the listing within 10 business days. We may keep a record so it isn't re-added by suggestion.
2. Claiming Your Listing
To claim a listing, you must prove you're authorized to manage it, for example with a code sent to the business email domain or phone number on public record. Don't claim a listing you're not authorized to manage. If two people claim the same listing, we may ask for more proof and decide who manages it. We may remove your access if you leave the business or the business tells us to.
You're responsible for keeping your listing accurate. You can edit most details directly; some changes (name, category, address, licenses) may be reviewed before they appear.
3. Verification and Badges
Badges show what we checked and when. The current badges and their requirements are on our Badges page:
- Not Yet Verified: built from public info; not claimed.
- Claimed: the owner proved control through business email or phone.
- Verified: identity checked, a code mailed to the address, and, for health and legal providers, a license check with the issuing board.
- Pledged: the owner made the five promises of The Pledge, in writing.
- Community Badge: earned from real community reviews.
Badges can't be bought. No plan, sponsorship, ad, or payment of any kind earns, upgrades, keeps, or protects a badge, and no badge is a reward for buying anything. Paid plans don't change reviews, ratings, or badge decisions.
We may pause or remove a badge if information becomes out of date, a license lapses, the business breaks The Pledge, or we receive credible, confirmed reports of discrimination or harm. We'll tell you and explain how to restore it.
Using badges off the site. While you hold a badge, you may display it on your website, storefront window, and social media, linked to your verification page, without changing it. Stop when the badge is paused or removed. Don't imply a badge you don't have or that we endorse your products.
Licensed professionals. If you're listed as a licensed provider (for example, medical, mental health, dental, legal), you confirm your license is active and in good standing, and you'll tell us within 10 days if it's suspended, restricted, or revoked.
4. Reviews About Your Business
Community members may review your business under our Community Guidelines. You may respond publicly and politely.
You agree not to:
- Write reviews of your own business or competitors, or have employees, family, or agents do so.
- Offer anything of value (discounts, gifts, entries) in exchange for reviews, or for changing or removing a review.
- Ask only happy customers for reviews ("review gating"), or use contracts to stop customers from posting honest reviews. Contract terms like that are void under the Consumer Review Fairness Act.
- Threaten or retaliate against a reviewer.
These rules follow the FTC's Rule on the Use of Consumer Reviews and Testimonials. If we find a violation, we may remove the reviews, pause badges, show a notice on your listing, and suspend your plan without a refund.
You may report a review you believe breaks our guidelines. We don't remove honest reviews because they're negative, and paying us never affects whether a review is removed.
5. Paid Plans
| Plan | Monthly | Yearly | What you get |
|---|---|---|---|
| Pro | $29 | $290 | Unlimited photos and video, booking, offer, and quote buttons, monthly numbers on who found you, and no competitor ads on your listing |
| Featured | $79 | $790 | Everything in Pro, a labeled Featured spot at the top of your category in your city, and a monthly newsletter mention |
| Category Owner | From $250 per category per metro | Not offered | A labeled "Presented by" spot on one category in one metro; one owner per category and metro |
Plan features, availability, and prices are described on our pricing page at the time you buy, and that description is part of these terms. Prices are in U.S. dollars and don't include taxes, which we'll add where required.
What "Featured" and "Category Owner" mean. They are paid, labeled placements. They don't change your badges or reviews and don't affect where you appear in regular, unlabeled results. Featured and Category Owner slots are limited per metro and offered first come, first served. We may set eligibility (for example, Featured and Category Owner may require at least the Claimed badge). If a category is reorganized or a metro is redefined, we'll offer a comparable slot or a prorated refund.
Founding offer. Founding businesses can get 3 months of Pro or Featured free with a promo code. Your plan renews at the founding price after the free period unless you cancel first, and we'll email you before it does.
6. Billing and Automatic Renewal
Read this section carefully. It explains how your plan renews and how to cancel.
Your plan renews automatically at the end of each billing period (monthly or yearly) and we charge the payment method on file the price then in effect, plus tax, until you cancel. Before you buy, our checkout page will show the plan, price, billing frequency, that it renews automatically until canceled, and how to cancel, and you must check a box (separate from accepting these terms) agreeing to the automatic renewal. We'll email you a confirmation with the same information and how to cancel.
Free trials and promotional prices. If your plan starts with a free or discounted period, we'll tell you at signup how long it lasts and what you'll be charged after. For any free period longer than 31 days, we'll email you 3 to 21 days before it ends. If you don't cancel before it ends, your paid plan begins and you'll be charged.
Yearly plans. We'll email you a reminder at least 15 days and no more than 45 days before a yearly plan renews, with the renewal date, price, and how to cancel. We'll also send a yearly reminder for any plan with your renewal terms and how to cancel.
Price changes. We'll email you at least 30 days before a price change takes effect on your plan, with the new price, the date it starts, and how to cancel. The change applies starting with your next billing period after that date.
Payments. Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for all fees when due. If a payment fails, we'll try again over 14 days and email you. If we can't collect, we may downgrade your listing to free; your free listing and earned badges stay.
7. Canceling
You can cancel anytime, online, in one step, from your billing settings (the Plan page in your account at allthethings.gay/portal/plan), or by emailing billing@allthethings.gay. You don't need to call or talk to anyone. We'll confirm your cancellation by email.
When you cancel, auto-renewal stops. Your paid features continue until the end of the period you already paid for, and then your listing returns to the free plan. Your listing and earned badges stay.
8. Refunds
Subscriptions are non-refundable. Plan charges, including yearly plans and renewals, are not refunded, and we don't give partial refunds for unused time. You can cancel anytime to stop future charges; your paid features continue until the end of the period you already paid for.
If something went wrong, for example you were charged in error, or a paid feature didn't work for a meaningful period because of us, you can ask for a refund using our refund request form. We review every request and decide at our discretion. Approved refunds go back to the original payment method, usually within 5 to 10 business days.
Purchases from businesses listed on the Service (products, tickets, services) are sold by those businesses, not by us. Their own refund and return terms apply; see our Marketplace Buyer Terms.
If you file a chargeback without contacting us first, we may suspend paid features while it's resolved.
9. Changing Plans
Upgrades take effect right away and we charge the prorated difference for the rest of your billing period. Downgrades take effect at the next renewal.
10. Your Content and Our License
You keep ownership of the content you add to your listing or storefront (text, logos, photos, video, offers). You give us a non-exclusive, worldwide, royalty-free license to host, display, adapt for format, and distribute it on the Service, in our newsletter, in our apps, on our social accounts, and in promotion of the Service (for example, "find LGBTQIA+-friendly dentists in Little Rock" posts) while your listing is active and for a reasonable time after. You promise you have the rights to it, it's accurate, and it doesn't infringe anyone's rights.
Business information is not personal data we can't use. Facts about your business (name, address, hours, category, badges) may be shown, shared with partners, and included in directory data we license to others, even if you stop paying. Personal contact details you give us privately (your name, personal phone, personal email) stay private, as described in our Privacy Policy.
11. Your Responsibilities
You agree to:
- Keep your listing truthful, including prices, services, credentials, and accessibility information.
- Follow all laws that apply to your business, including licensing, advertising, consumer protection, nondiscrimination, and privacy laws.
- Not use contact information of people who reach you through the Service for unrelated marketing without their consent, and follow CAN-SPAM and the TCPA when you message them.
- Not use the Service to collect sensitive information about people beyond what's needed to serve them.
- Not make health claims or guarantees of results. "Inclusive" or "welcoming" describes how people are treated, not medical outcomes.
12. Analytics We Give You
Pro and higher plans include reports such as views, clicks, calls, and searches that showed your listing. Reports are aggregate. We don't give you the identity of people who viewed your listing, and you agree not to try to identify them.
13. Suspension and Termination
You may close your business account anytime. We may suspend or end your access, remove your listing, or pause badges if you break these terms, the Terms of Use, or the law, if needed to protect people, or if we stop offering a feature. If we stop offering a paid plan for reasons other than your breach, we'll refund the unused prepaid portion.
14. Disclaimers and Limits on Liability
We don't promise any level of traffic, leads, calls, sales, or search ranking, on our site or on search engines. The disclaimers and liability limits in our Terms of Use apply to you, except that our total liability to a Business is limited to the fees you paid us in the 12 months before the claim.
Indemnity. You'll defend and cover us against third-party claims arising from your business, your products or services, your content, or your breach of these terms or the law.
15. Disputes and Governing Law
The dispute resolution section of our Terms of Use applies to these terms. Arkansas law governs.
16. Changes
We may update these terms. For material changes, we'll email you at least 30 days before they take effect. If you don't agree, you can cancel before the effective date and get a prorated refund of any prepaid time after it.
